Terms of UseWelcome to the Hotel Lotte Co., Ltd. (hereinafter referred to as “Company”) site terms and conditions page for use of this site (as specified below). Your use of this Site is subject to the specific terms and conditions set forth within this Site or on some individual pages (collectively, “These Terms of Use”) and all applicable laws and regulations, including laws regarding copyright, trademark, and other intellectual property rights.
The purpose of these Terms and Conditions is to define the rights, obligations and responsibilities of the online mall and the Users who avail of the internet-related services (hereinafter referred to as "Services") provided by the website operated by Hotel LOTTE (hereinafter referred to as "LOTTE HOTELS website").
- 1."LOTTE HOTELS website" means the virtual business site established for HOTEL LOTTE Co., Ltd. to provide goods or services (hereinafter referred to as "goods, etc.") to uUsers for transactions of goods, etc. by using information and communication equipment such as computers, etc. This term is also used to refer to the business operator of the online mall.
- 2."User" refers to members and non-members who access the LOTTE HOTELS website and use the Services provided by the LOTTE HOTELS website in accordance with these Terms and Conditions.
- 3.“Member" refers to a person who has registered as a member by providing personal information on the LOTTE HOTELS website and who can continuously receive information from the LOTTE HOTELS website and use the Services provided by the LOTTE HOTELS website.
- 4.“Non-member” refers to those who use the Services provided by the LOTTE HOTELS website without registering as a member.
- 1.The LOTTE HOTELS website shall post the contents of these Terms and Conditions, its name and representative's name, business address (including the address of the place where consumer complaints can be handled), telephone number, fax number, e-mail address, business license number, e-commerce business registration number, and personal information manager on the initial service screen (front page) of the LOTTE HOTELS website so that Users can easily recognize them. However, the LOTTE HOTELS website may also make the contents of the Terms and Conditions available to Users on a linked screen.
- 2.The LOTTE HOTELS website shall provide a separate linked screen or pop-up screen so that the User can understand the important contents, such as cancellation of subscription, delivery responsibility and refund conditions among the contents stipulated in the Terms and Conditions before the User agrees to the Terms and Conditions, and shall request the User's confirmation.
- 3.The LOTTE HOTELS website may revise these Terms and Conditions as long as the revision does not violate relevant laws, including the Act on the Regulation of Terms and Conditions, the Act on Consumer Protection in Electronic Commerce, the Framework Act on Electronic Documents and Transactions, the Digital Signature Act, the Act on the Promotion of Information and Communications Network Utilization and Information Protection, the Act on Door-to-Door Sales, the Act on Financial Consumer Protection, and the Customs Act, etc.
- 4.If "LOTTE HOTELS Homepage" revises the Terms and Conditions, it will state the effective date and the reason for the revision and will announce it on the initial screen of the online mall together with the current Terms and Conditions from 7 days prior to the effective date until the day before the effective date. However, in the case of a change in the content of the Terms and Conditions to the detriment of Users, a grace period of at least 30 days must be given in advance. The LOTTE HOTELS website will provide a clear comparison of the Terms and Conditions before and after the revision to ensure that members can easily understand the changes.
- 5.If the LOTTE HOTELS website amends these Terms and Conditions, the amended Terms and Conditions shall apply only to agreements entered into after the effective date, and the provisions of the Terms and Conditions in effect prior to the amendment shall apply to agreements entered into prior to the effective date. However, if a User who has already entered into an agreement notifies the LOTTE HOTELS website that he/she wishes to be subject to the provisions of the revised Terms and Conditions within the notice period under the revised Terms and Conditions pursuant to Paragraph 3 and receives the consent of the LOTTE HOTELS website, the provisions of the revised Terms and Conditions shall apply.
- 6. Matters not addressed in these Terms and Conditions and their interpretation shall be governed by applicable laws or customs, such as the Act on Consumer Protection in Electronic Commerce, the Act on the Regulation of Terms and Conditions, and the Consumer Protection Guidelines in Electronic Commerce established by the Fair Trade Commission.
- 1.The LOTTE HOTELS website shall perform the following tasks:

- ① Provide information about goods and services and enter into purchase contracts
- ② Deliver goods or services for which a purchase agreement has been entered into
- ③ Other tasks specified by the LOTTE HOTELS website
- 2.LOTTE HOTELS website may change the contents of the goods or services to be provided by an agreement to be concluded in the future, if the goods or services are out of stock or the technical specifications are changed. In this case, the content of the changed goods or services and the date of their provision will be immediately published in the place where the content of the current goods or services is published.
- 3.If the LOTTE HOTELS website changes the content of the service it has agreed to provide to the User for reasons such as out-of-stock goods or changes in technical specifications, it will immediately notify the User of the reason at the address where the User can be notified.
- 4. In the case of the previous paragraph, the LOTTE HOTELS website will compensate the User for any damage that the User may have suffered as a result. This shall not apply, however, if LOTTE HOTELS website proves that there was no intent or negligence.
- 1.The LOTTE HOTELS website may temporarily suspend the provision of the Services in the event of maintenance, inspection, replacement or breakdown of information and communication facilities such as computers, or interruption of communications.
- 2.The LOTTE HOTELS website will compensate the User or a third party for any damage suffered by the User or a third party as a result of the temporary suspension of the provision of the Services for the reasons set out in Paragraph 1. This shall not apply, however, if LOTTE HOTELS website proves that there was no intent or negligence.
- 3. In the event that the LOTTE HOTELS website is unable to provide the Services due to a change in its business scope, abandonment of its business, merger of businesses, etc., it shall notify the Users in the manner set forth in Article 8 and compensate them on the basis of the terms and conditions originally proposed by the LOTTE HOTELS website. However, if the LOTTE HOTELS website has not communicated the terms of compensation, etc., the LOTTE HOTELS website shall pay the User's Miles or Points in kind or in cash equivalent to their value in the currency used by the Company.
- 1. The User may become a member free of charge and shall apply for membership by filling in the membership information on the registration form provided on the LOTTE HOTELS website and indicating that he/she agrees to these Terms and Conditions.

2.The LOTTE HOTELS website will register Users who have applied for membership in accordance with Paragraph 1, unless they are subject to any of the following items:
- ① If the applicant has previously lost membership pursuant to Article 7, Paragraph 3 of these Terms and Conditions. Except in the event that 3 or more years have passed since they lost membership pursuant to Article 7, Paragraph 3, and the LOTTE HOTELS website has approved their re-acquisition of membership.
- ② If there are any falsehoods, omissions or errors in the registration form
- ③ If the LOTTE HOTELS website believes that registering a User poses significant technical difficulty with the LOTTE HOTELS website
- 3. As per the basic LOTTE Family Membership Policy, Users must be at least 19 years old to sign up (Users under the age of 19 must provide a legal representative’s consent as per Article 4 Paragraph 3-C of the Consumer Protection Guidelines for Registration and Product Orders.) Only members 19 years old or above may make a purchase on the LOTTE HOTELS website.
- 4. Registration shall be deemed to have been completed when the LOTTE HOTELS website's approval is received by the registered User.
- 5.The member shall immediately notify the LOTTE HOTELS website of any changes to the membership information registered on the LOTTE HOTELS website or modify such information in accordance with the method prescribed by the LOTTE HOTELS website. (To Terms and Conditions)
- 6. The LOTTE HOTELS website allows non-members to purchase goods or services. In such cases, these Terms and Conditions shall apply, unless separate terms and conditions or special agreements are in place. However, the LOTTE HOTELS website does not offer any services that are only available by registering as a member.
- 1.A member may request to withdraw his/her membership on the LOTTE HOTELS website at any time. If the member requests to withdraw his/her membership, the LOTTE HOTELS website will immediately take the necessary measures to withdraw his/her membership.

2.If the member is subject to any of the following reasons, the LOTTE HOTELS website may restrict the member's use of certain services or temporarily suspend the membership of the member.
- ① If the member registered using false information in the membership registration application
- ② If the member does not fulfill their obligations before or on the due date in relation to the payment for goods purchased by the member on the LOTTE HOTELS website or other use of the LOTTE HOTELS website
- ③ Theft of another person’s ID and password or personal information
- ④ Engaging in any action on the LOTTE HOTELS website that may slander or disadvantage a person
- ⑤ Violating electronic commerce practices and order, such as disrupting the use of the LOTTE HOTELS website by a third party
- ⑥ Publishing pornography or sharing a pornography website on the LOTTE HOTELS website
- ⑦ Engaging in an activity through the LOTTE HOTELS website that violates these Terms and Conditions, relevant laws or public order
- ⑧ Intentional disruption of other Service operations
- 3.The LOTTE HOTELS website may terminate a membership if the member repeats an action listed in Paragraph 2 twice or more, or does not remedy it within 30 days of the restriction/suspension of membership.
- 4.If the LOTTE HOTELS website terminates a membership, the member's registration will be canceled. In this case, the member will be notified at least 30 days prior to the cancellation of the membership registration and will be given the opportunity to explain.
- 1.In the event that the LOTTE HOTELS website needs to send notifications to its members, it may use the email addresses provided and designated in advance by the members.
- 2.In the case of general notifications to unspecified members, the LOTTE HOTELS website may publish these on the LOTTE HOTELS website for a week or more instead of notifying members individually. However, the LOTTE HOTELS website will notify its members individually for matters that have a significant impact on the members' transactions.
Users of the LOTTE HOTELS website may submit a purchase request using the following or similar methods, and the LOTTE HOTELS website shall provide the following information regarding the User's purchase request in a clear and understandable manner. However, if the User is a member, the LOTTE HOTELS website may exclude the application of Paragraphs 2 to 4 to the member.
- 1. Searching for and selecting goods, etc.
- 2. Entering their name, address, phone number, e-mail (or mobile phone number), etc.
- 3. Confirmation of details related to the Terms and Conditions, services for which the right to cancel the purchase is limited, and costs such as shipping and installation fees
- 4. Acceptance of these Terms and Conditions and confirmation or rejection of Paragraph 3 above (e.g. by mouse click)
- 5. Request for purchase of goods, etc. and confirmation thereof or consent to confirmation on the LOTTE HOTELS website
- 6. Selecting the payment method

1.The LOTTE HOTELS website may not accept the purchase requests referred to in Article 9 if they are subject to any of the following subparagraphs. However, if an agreement is made with a minor, the LOTTE HOTELS website must inform the minor that he or she or his or her legal guardian may cancel the agreement if the legal guardian's consent is not obtained.
- ① If there is false, incorrect or incomplete information
- ② If goods and services prohibited by the Juvenile Protection Act, such as cigarettes and alcohol, are purchased by a minor
- ③ Other cases where the LOTTE HOTELS website determines that the acceptance of the purchase request would severely interfere with its operations or technology
- 2.The agreement shall be deemed to have been concluded when the LOTTE HOTELS website’s acceptance is communicated to the User through the receipt confirmation notification as outlined in Article 12 Paragraph 1.
- 3.The LOTTE HOTELS website’s acceptance notification must include information such as a confirmation of the User’s purchase request, availability of the goods or services, or correction or cancellation of the purchase request.

1.Payment for goods or services purchased through the LOTTE HOTELS website may be made by any of the following methods. However, the LOTTE HOTELS website may not impose additional fees related to the User's payment method for the purchase of goods and services.
- ① Various bank transfers, such as telephone banking, internet banking, mail banking, etc.
- ② Prepaid cards, debit cards, credit cards, and other card payments
- ③ Online deposit without a bank book
- ④ Payment through digital currencies
- ⑤ Paid on receipt
- ⑥ Payment with points issued by the LOTTE HOTELS website, such as miles
- ⑦ Payment with a gift certificate that has an agreement with the LOTTE HOTELS website or that has been approved by the LOTTE HOTELS website
- ⑧ Payment through other electronic payment methods
- 1.When a User makes a purchase request, the LOTTE HOTELS website will send a notification to confirm receipt of the request.
- 2. If, upon receipt of the confirmation of receipt notification, the User discovers any discrepancies with the original purchase request, the User may immediately request a modification or cancellation of the purchase. The LOTTE HOTELS website shall promptly process the User's request prior to shipping.
- 1.If there is no separate agreement with the User regarding the schedule of delivery of the goods, etc., the LOTTE HOTELS website will take the necessary measures to deliver the goods and services within seven days from the User's request, including ordering, packaging and other preparations. However, if the LOTTE HOTELS website has already received all or part of the payment for the goods, etc., it must take action within two working days of receiving such payment. LOTTE HOTELS website will ensure that the User is informed about the procedure and progress of the delivery of the goods, etc.
- 2.The LOTTE HOTELS website shall specify the shipping method, the party responsible for paying the shipping fee for each method, and the shipping schedule associated with the goods purchased by the User. If the LOTTE HOTELS website fails to meet the agreed shipping schedule, it shall compensate the User for any resulting damages. However, this does not apply if the LOTTE HOTELS website can prove that the delay is not due to its intent or negligence.
- 1.If the LOTTE HOTELS website is unable to provide the goods and services because the requested items are sold out, or due to any other reason, it must notify the User of the situation. If the LOTTE HOTELS website has already received payment for the goods and services, it must either cancel the agreement or issue a refund within three days of receiving the payment, or, if payment was not received in advance, within two days of the occurrence of the reason preventing fulfillment.
- 1.A User who has entered into an agreement with the LOTTE HOTELS website for the purchase of goods and services may not cancel their purchase within seven days of receiving the receipt confirmation notification.

2. After a User has received goods, etc., they may return or exchange them if any of the following applies:
- ① If the goods, etc. are damaged or destroyed due to the User's fault (However, if the packaging was damaged solely to inspect the contents of the goods, etc., the purchase may be canceled)
- ② If the value of the goods, etc. is significantly diminished due to the User's usage or partial consumption
- ③ If the value of the goods, etc. is significantly diminished to the extent that they cannot be resold due to the passage of time
- ④ If the goods, etc. can be duplicated to provide the same performance, and the packaging of the original goods or services has been damaged
- 3. In the case of Paragraph 2 Subparagraphs 2 to 4, if the LOTTE HOTELS website has not provided samples or has not clearly informed the consumer in an easily understandable manner that the purchase cannot be canceled in advance, the User cannot be prevented from canceling the purchase.
- 4. Notwithstanding the provisions of Paragraphs 1 and 2, if the content of the goods, etc. differs from what was displayed or advertised or does not match the agreement, the User may cancel their purchase within three months from the date of receipt of the goods or services, or within 30 days from the date the User became aware or could have become aware of the discrepancy.
- 1.If the LOTTE HOTELS website receives a return of goods, etc. from a User, it will refund the amount already paid for the goods within three working days. If the LOTTE HOTELS website delays the refund, it shall pay the User late payment interest calculated by multiplying the late payment interest rate determined and published by the Fair Trade Commission by the duration of the delay.
- 2.When the LOTTE HOTELS website processes the refund, if the User has paid for the goods, etc. using a payment method such as a credit card or digital currency, the LOTTE HOTELS website shall promptly request the payment provider to suspend or cancel the claim for the purchase price of the goods, etc.
- 3. In the event of a purchase cancellation, the User shall bear the cost of returning the supplied goods, etc.The LOTTE HOTELS website will not impose any penalty or a demand for compensation on the User for the cancellation of his/her purchase. However, if the cancellation of the purchase is due to the fact that the goods differ from what was displayed or advertised, or if they do not perform according to the agreement, the LOTTE HOTELS website will bear the cost of returning the goods.
- 4. If the User has paid shipping costs to receive the goods, etc., the LOTTE HOTELS website will clearly indicate who will be responsible for these costs if the purchase is canceled.
- 1.When the LOTTE HOTELS website collects personal information that could be used to identify the User, it must obtain the User's prior consent.

2. The personal information provided by the User may not be used for purposes other than those agreed, nor may it be disclosed to third parties, and the LOTTE HOTELS website shall bear any responsibility in this regard. However, the following cases are exempt.
- ① If separate consent was received from the data subject
- ② If there are special regulations in other laws
- ③ If the data subject or their legal representative is unable to express their intention or if prior consent cannot be obtained due to an unknown address or similar reasons, and it is deemed urgently necessary to protect the life, body, or property interests of the data subject or a third party
- ④ If personal information is provided in a manner that does not allow for the identification of specific individuals, such as for compiling statistics or conducting academic research
- 3.In cases where the LOTTE HOTELS website is required to obtain the User's consent pursuant to Paragraph 2, it shall provide prior notice of the matters specified in the Personal Information Protection Act and other relevant laws, and the User shall have the right to revoke such consent at any time.
- 4. The User may, at any time, request access to his/her personal data and request the correction of any inaccuracies in his/her personal data held by the LOTTE HOTELS website, and the LOTTE HOTELS website is obliged to take the necessary measures without delay.
- 5.In order to protect personal information, the LOTTE HOTELS website limits the number of personal information handlers to a minimum and assumes full responsibility for any damages suffered by Users in the event of loss, theft, leakage or alteration of personal information which is caused by the negligence of the LOTTE HOTELS website.
- 6.The LOTTE HOTELS website or any third party that has received personal information from the LOTTE HOTELS website shall destroy the personal information without delay once the purpose for which the information was collected or provided has been fulfilled.
- 1.The LOTTE HOTELS website shall not engage in any activity that is prohibited by law or these Terms and Conditions, or that is contrary to public policy. The LOTTE HOTELS website shall make its best efforts to continuously and safely provide goods, etc. in accordance with these Terms.
- 2.The LOTTE HOTELS website must have a security system in place to protect Users' personal information (including credit information) so that Users can safely use the Services.
- 3.In the event that the LOTTE HOTELS website causes damage to a User by engaging in unfair labeling or advertising, as defined in Article 3 of the Act on Fair Labeling and Advertising, with respect to a product or service, the LOTTE HOTELS website shall be liable for compensation for such damage.
- 4.The LOTTE HOTELS website will not send unsolicited commercial e-mails to Users who have not given their consent to receive such emails.
- 1. The member is responsible for managing their ID and password, except in cases specified in Article 17.
- 2. Members must not allow a third party to use their ID and password.
- 3. If a member becomes aware that his/her ID and password have been stolen or are being used by a third party, he/she must immediately notify the LOTTE HOTELS website and follow any instructions provided by the LOTTE HOTELS website.
The User must not engage in any of the following activities.
- 1. Provide false information when registering or modifying registration
- 2. Use the personal information of another person
- 3.Change the information posted on the LOTTE HOTELS website
- 4.Send or post information (computer programs, etc.) that was not approved by the LOTTE HOTELS website
- 5.Infringe upon the copyrights or other intellectual property rights of the LOTTE HOTELS website or third parties
- 6.Any actions that damage the reputation or interfere with the business of LOTTE HOTELS website or other third parties
- 7. Publish or post on the LOTTE HOTELS website obscene or violent messages, images, audio recordings or any other information that violates public order and morality
- 8. Any other activity that violates the law or is deemed inappropriate by the LOTTE HOTELS website
- 1. When an upper-level mall and a lower-level mall are linked through a method such as a hyperlink (e.g., the hyperlink target includes text, images, or videos), the former is referred to as the "connecting mall (website)" and the latter as the "connected mall (website)."
- 2. On its initial screen or in a pop-up that appears when the User accesses the connecting mall, if the connecting mall clearly states that it does not guarantee any transactions between Users and the connected mall regarding goods or services provided independently by the connected mall, then the connecting mall shall not be liable for such transactions.
- 1.The copyright and other intellectual property rights to the works created by the LOTTE HOTELS website belong to the LOTTE HOTELS website.
- 2. Users may not distribute any information obtained through the LOTTE HOTELS website that is subject to the intellectual property rights of the LOTTE HOTELS website for profit, or permit any third party to use such information by copying, transmitting, publishing, distributing, broadcasting, or using the information in any other manner, without the prior consent of the LOTTE HOTELS website.
- 3.If the LOTTE HOTELS website uses any copyrights bound to a User in accordance with an agreement, they must notify the User.
- 1.The LOTTE HOTELS website establishes and operates a claims handling organization to address legitimate opinions or complaints raised by Users and provide compensation for any damages incurred.
- 2.The LOTTE HOTELS website will give priority to handling complaints and opinions submitted by Users. However, if a prompt resolution is not possible, the User will be informed in a timely manner of the reason for the delay and the estimated time for resolution.
- 3.If a User submits a claim for damages related to an e-commerce dispute between the LOTTE HOTELS website and the User, the claim may be subject to mediation by a dispute resolution agency commissioned by the Fair Trade Commission or the city/provincial governor.
- 1.Any lawsuit relating to e-commerce disputes between the LOTTE HOTELS website and the User will be determined by the User's address at the time of filing the lawsuit or, in the absence of an address, the district court with jurisdiction over the User's place of residence will have exclusive jurisdiction. However, if the User's address or domicile is not known at the time of filing the suit, or if the User is domiciled abroad, the suit shall be filed with the competent court in accordance with the Civil Procedure Code.
- 2.The laws of the Republic of Korea shall apply to any e-commerce dispute arising between the Company and a User.
